Trademark, Law and Design: An interrelationship?
Graphic design is intricately connected to trademark and branding, and its importance becomes even more evident when considering legal aspects. Being both a law student and a graphic designer, I have always wanted to study what links them. Graphic design is crucial in creating distinctive visual elements for trademarks because a well-designed trademark is more likely to be deemed distinctive and eligible for legal protection. In legal proceedings related to trademark infringement, the visual aspects of the trademarks are central to establishing the case. Graphic design aids in presenting evidence and arguing the distinctiveness of the trademarks in question. In essence, graphic design is not only a creative endeavor but a strategic and legal one. It directly influences the legal protection, recognition, and enforcement of trademarks and branding, making it an integral aspect of the intersection between design and law.
